We have found in the Customer Agreement document that the customer and company act as principals and the company does not act as an agent on behalf of the customer. This means that Gerchik & Co is a market maker and a counterparty to each client’s trade. In general, dealing with market makers involves a conflict of interest because they do not transmit every customer deal and hope that customers will lose. Every loss of customers is their profit
